THIS AGREEMENT, made this 13th day of December, A. D.
1898, by and between WALTER S. MAXWELL, of the City of Los
Angeles, California, party of the first part, and THOMAS R.
BARD, S. C. GRAHAM, WILLIAM LOFTUS, D. T. PERKINS, and C. H.
McKEVETT, parties of the second part.

WITNESSETH: That the party of the first part, for and in consideration of One Dollar, to him in hand paid by the parties of the second part, and for other good and valuable considerations, him thereunto moving, doth hereby GIVE AND GRANT unto the said parties of the second part, their heirs and assigns, THE RIGHT TO PURCHASE, at any time on or before the fourteenth day of September, A. D. 1899, the following described pieces or parcels of land, situated in the County of Orange, State of California, and being, the Northeast one-fourth (N.E.1/4) of the Northwest one-fourth (N.W.l/4),and the Northeast one-fourth (N.E.1/4) of Section Nine (9), Township three (3) South, Range Nine (9) West, S.B.B.& M., (being the same premises conveyed to the party of the first

part hereto by the said parties of the second part hereto,

and delivered contemporaneously herewith by deed dated the 3rd day of December, 1898), for the sum of

Four thousand seven hundred and fifty (4,750.00) Dollars, gold coin of the United States, and upon the receipt of said sum on or before said date, the party of the first part, for himself, his heirs, executors, administrators or assigns, agrees to execute and deliver to the said parties of the second part, a grant, bargain and sale deed, conveying to the said parties of the second part, the said premises in undivid­ed parts or portions, each to each, that is to say: To the said Thomas R. Bard, an undivided one-fourth thereof; to the said S. C. Graham an undivided one-fourth thereof; to the said William Loftus, an undivided one-fourth thereof; to the Said William Loftus, an undivided one-fourth thereof; to the said D. T. Perkins and undivided one-eighth thereof; to the said C. K. McKevett an undivided one-eighth thereof, - or to their heirs or assigns.
